An Alabama man, Bryan Shawn Smith, 37, from Huntsville, received a 34-month prison sentence last Friday for his role in the January 6, 2021 Capitol breach. Smith’s charges included felony offenses for civil disorder and assaulting, resisting, or impeding certain officers, with additional misdemeanor offenses for his conduct on Capitol grounds, as reported bythe Department of Justice.
U.S. District Judge Randolph D. Moss, who presided over the case, also sentenced Smith to 36 months of supervised release and imposed a $2,000 fine. According to court documents, Smith was among the rioters on the Lower West Terrace and was caught on camera at 2:10 p.m. refusing an officer’s command to move away from a doorway, thus allowing mob entry. Footage later showed him carrying and sparking a stun gun before passing it to other rioters, as per evidence from the trial.
The stun gun Smith passed along played a role in further assaults against law enforcement officers during the riot. Vitali Gossjankowski, another rioter who received the stun gun from Smith, attempted to use it to assault an officer. Smith reentered the Tunnel at around 3:16 p.m. and pushed against the police line, contributing to the violent efforts of the mob attempting to breach the Capitol.
Smith was apprehended by the FBI on December 4, 2022, in Huntsville, and has been held accountable for his part in the offenses that interrupted a joint session of Congress. The case was prosecuted by the U.S. Attorney s Office for the District of Columbia, with assistance from the Department of Justice National Security Division s Counterterrorism Section. The Northern District of Alabama also offered assistance, the FBI s Birmingham and Washington Field Offices led the investigation along with contributions from the United States Capitol Police and the Metropolitan Police Department.
Over the past 46 months, more than 1,561 individuals have faced charges connected to the Capitol riots, including over 590 charged with felonies for assaulting or impeding law enforcement.
