This week, a number of states, members of Congress, medical associations, and policy groups filed amicus briefs in support of Attorney General Gentner Drummond’s request that the U.S. Supreme Court restore Title X money to Oklahoma. After a recent appeal court judgment affirmed the Biden Administration’s policy permitting abstention from abortion referrals following the Dobbs decision, Oklahoma lost its Title X funds. The Oklahoma Attorney General stated that the Oklahoma State Department of Health had relied on Title X money for more than 40 years to deliver critical healthcare services.
In October, Drummond filed a petition for certiorari to overturn the Tenth Circuit’s ruling that the Oklahoma State Department of Health might be denied federal funding because of its stance on abortion referrals. “This strong show of support from states, federal lawmakers, medical professionals, and policy organizations demonstrates the far-reaching implications of the Biden Administration’s unprecedented action,” he stressed, according to the Attorney General of Oklahoma.
Because of its effect on states’ ability to regulate abortion laws, twenty-one states have backed Texas in its lawsuit, pushing the Supreme Court to review it. A brief submitted by 19 members of Congress, including the delegation from Oklahoma, emphasized the Weldon Amendment’s protection of institutions’ freedom to decline referrals for abortions without facing consequences. Concerns regarding possible discrimination in Oklahoma were also raised by healthcare organizations, such as the American Association of Pro-Life Obstetricians & Gynecologists, which represents more than 22,000 physicians. The campaign was joined by more than 35 groups that support public policy and religious liberty. “Protect Oklahoma and its healthcare professionals from unlawful discrimination and ensure that all Oklahomans have access to care,” according to the state attorney general, is what they contend the Supreme Court deserves.
