Modesto Man Sentenced to Federal Prison for Illegal Firearm Possession

In a recent post, the Modesto Police Department stated that Eleuterio Avalos, a 32-year-old resident of Modesto, had been found guilty of illegal firearm possession and given a sentence of more than three years in federal prison. Avalos will serve 36 months of supervised release after his jail sentence. Avalos was given the sentence after he tried to elude police during a traffic stop and was observed running away on foot while throwing away a gun. Given Avalos’s prior felony convictions for assault with a firearm on a person and assault with a deadly weapon, this conviction is especially noteworthy.

The Modesto Police Department’s social media statement stated that the ATF Task Force, the Stanislaus County District Attorney’s Office, and the Street Gang Unit of the department worked together to swiftly and effectively prosecute Avalos.

Following the unsuccessful traffic stop on November 18, 2022, the inquiry was started. During his escape, Avalos was seen taking a gun from his waistband; this behavior only stopped when he was apprehended by police. Later, the abandoned weapon was found and taken into custody by the Modesto Police Department. The federal accusations that Avalos faced were the result of this sequence of events, primarily because 18 U.S.C. 922(g)(1) prohibits the unlawful possession of a firearm by an individual with a criminal record.

The statement from the Modesto Police Department highlights the need for ongoing attention to detail and interagency collaboration in combating crimes using firearms. The fact that Avalos was successfully brought to justice not only marks a victory in law enforcement cooperation, but it also greatly improves community safety.
