Modesto Man Sentenced to 37 Months for Illegal Firearm Possession Amidst Local-Federal Law Enforcement Collaboration

Eleuterio Avalos, a 32-year-old man from Modesto, was found guilty of unlawfully possessing a firearm and given a sentence of more than three years in federal prison. According to a Modesto Police Department social media post, the sentence was the consequence of coordinated efforts by federal and local law enforcement.

Details from the Modesto Police Department’s Facebook post indicate that Avalos was captured after a police pursuit on November 18, 2022. Avalos drew a gun from his waistband during this pursuit in an attempt to quickly and completely flee following a traffic check. Even though he threw the gun away during the escape, the authorities later found it. Avalos was already forbidden from carrying weapons by 18 U.S.C. 922(g)(1) due to his prior convictions for assault-related offenses.

The Alcohol, Tobacco, Firearms and Explosives (ATF) Task Force, the Stanislaus County District Attorney’s Office, and the Modesto Police Department’s Street Gang Unit all contributed resources to the cooperative investigation. The United States Attorney’s Office ultimately filed federal charges against Avalos as a result of their combined efforts.

According to a public statement from the Modesto Police Department, these measures demonstrate “the commitment of local and federal law enforcement agencies to work together in removing illegal firearms from the community and holding offenders accountable for violent crimes.”
