For allegedly assaulting a middle school resource deputy who had filed battery charges against their son the day before, a 46-year-old man and his 45-year-old wife were taken into custody in Florida.

According to court documents examined by Law&Crime, Jorge Rivera and Dagmarie Aponte Iturrino were both arrested on Tuesday and charged with trespassing on school property after a warning, disrupting a school function, battery on a law enforcement officer, and violently resisting arrest.

In addition, Rivera is charged with grand theft, robbery with a weapon, and assault or battery against certain officials or workers.

The couple protested their son’s battery charge for pushing a girl at school the day before on the morning of November 19 at Deltona Middle School, according to a news release from the Volusia County Sheriff’s Office.

According to the release, Jorge became angry and began yelling at the deputy after the meeting didn’t go as planned. He was then asked to leave. Jorge knocked the deputy down, grabbed her Taser from her hand, then hit her in the head after Dagmarie shoved her against a wall in the corridor. The deputy managed to get to her feet, pull out her gun, order Jorge to stop using the Taser, and arrest him.

Because Rivera used a derogatory epithet about the deputy just before hitting her, authorities further enhanced some of the accusations against him to include a hate crime.

According to a probable cause affidavit, Rivera allegedly shoved the school principle to the side and placed him in a headlock during the interaction with the deputy, which led to the school official allegation of violence.

Body camera footage of the event, which included parts of the conversation between the resource officer and the parents in a school office that led to the physical altercation in the corridor, was made public by the sheriff’s office.

According to the three-minute video, Rivera in particular appeared to be acting aggressively right away, accusing the deputy of neglecting the children. She jumps up and tells the deputy they must go while Rivera keeps talking over him and pointing the finger at her.

Why are you so useless? Do you take pride in your lack of value? As his wife seemed to be trying to stop him, Rivera says this while he is still in the office. I pay your wage, you stupid b–, so shut up.

Then, using a disparaging phrase for a lesbian, Rivera calls the deputy a useless piece of s and says, “No wonder you’re a f d,” before leaving the office.

According to reports, the involved deputy was evaluated at a nearby hospital for concussion symptoms before being released.

As Volusia County Sheriff Mike Chitwood stated in a statement, “If you’re wondering why some kids in today’s society show no fear of consequences, look no further than these parents as Exhibit A.” I’m relieved they are in jail, and I hope they will be held completely responsible for this egregious assault on our deputy who was merely carrying out her duties.
