CLERMONT COUNTY, Ohio (DDN) – The toxicology tests have been appended to the crash report for the October crash that killed five persons.
According to the Ohio State Highway Patrol, Matthew Penny, 25, is the motorist who caused the fatal incident at the intersection of State Route 28 and Edenton Pleasant Plain Road.
A toxicology report revealed that Penny had 106 nanograms of marijuana per milliliter in his bloodstream. That is more than fifty times the legal limit of two nanograms.
Dustin McDole, 43, was the second driver involved in the incident. The toxicology report revealed that McDole had a blood alcohol level of.267. That’s more than three times the legal limit of 0.08.
According to investigators, the incident occurred when Penny, driving a Chrysler 300 northeast on State Route 28, entered the oncoming lane to overtake another car.
He collided with McDole, who was attempting to cross the road in a Subaru Legacy on Edenton Pleasant Plain Road. The hit caused a devastating rollover crash.
Three more people were killed in the collision. Andrea Iery, 42, was a passenger in McDole’s vehicle, while Chloe Love, 19, and Dezmen Jernigan, 18, were passengers in Penny’s automobile.
