Parents Sue After Infant Dies from Swallowing Battery Found Under Broken Dishwasher

A new wrongful death complaint claims that an Iowa baby passed away after ingesting a watch battery she discovered under the damaged dishwasher kick plate, which the landlord had neglected to fix despite repeated warnings.

Faith Ziaty’s parents, Haja Sesay and Barbejo Ziaty, claim in their complaint that their landlord failed to repair a broken kick plate beneath their dishwasher, where their daughter discovered an old watch battery and consumed it.

The case was filed in Iowa on August 17 and asks for unspecified damages for pain and suffering, medical costs, and other expenses.

According to the lawsuit, on September 27, 2022, the family moved into their Des Moines apartment, which is when the sequence of events that resulted in the girl’s death allegedly began.

The dishwasher in the apartment needed to be fixed, according to a resident move-in inventory sheet. The lawsuit claims that “the defendants failed to fix and/or replace it” in spite of reminders given both orally and in writing on the kick plate’s issue.

“As a result of defendants’ negligence, Faith Ziaty unnecessarily suffered from preventable physical and mental pain and suffering, loss of function and death,” as per the lawsuit.

The lawsuit claims that Faith Ziaty was not nearly a year old when she crawled into the kitchen, grabbed behind the shattered kick plate, and put her hands under the dishwasher.

There noticed an old watch battery among all the debris. According to the lawsuit, the girl put the battery in her mouth and swallowed it.

Her esophagus was damaged by the battery acid, which resulted in severe bleeding. The young child was transported to the hospital after her mother hurried her across the street to a nearby veterinarian clinic.

The next morning, she passed away. The girl was described as laid-back and perpetually joyful in her obituary.

“She was quite a speedy crawler, especially if you were in her good graces,” according to the tribute. “If you left the room, she would be right behind you wondering where you were going. She recently began learning to walk and was very good at hanging on to everything and steadying herself. If cartoons were on the TV, especially Cocomelon, she was happy and content. Of course, Faith loved being around her family who all love her very much.”
