A $450 mountain bike was taken from the back patio of an apartment in the Darcy building on March 25 by Hastings, who had previously followed a renter through the security gate, according to a San Mateo Daily Journal report. At 3:38 a.m. on May 24, Hastings broke into the flat once more by scaling a window, approaching the victim who was sleeping, and using a knife to switch on the light.

Officers discovered Hastings with a folding knife in his pocket close to the apartment complex before he fled the scene and threatened the victim with the weapon. Using the phrase “third strike” to highlight the seriousness of Hastings’ illegal behavior while out on bond for another felony, district attorney Steve Wagstaffe presented the case.

The trial had been scheduled for October 27 but was threatened with a severe punishment of 50 years to life because Hastings was accused of two counts of felony burglary and an enhancement for committing these crimes while free on bail.
