‘This is kick a kid’: Woman who dropkicked child after yelling ‘this is Jackass’ reaches plea deal

A West Virginia judge sentenced a 30-year-old woman to three years probation after she was caught on video kicking a child.

According to a criminal complaint obtained by Law&Crime, the incident occurred between June 27, 2022, and July 1, 2022, at an apartment in Huntington. The defendant, Staci Lynn Burgy, was captured on video with a young girl who was sitting in a pink chair. Burgy allegedly said “This is Jackass. This is kick a kid,” apparently referring to the early 2000s TV and movie franchise that depicts actors completing risky stunts for laughs.

Burgy jumped in the air and kicked the girl in the side, also known in professional wrestling circles as a dropkick. The victim suffered bruising, cops said. Her age was not included in the complaint. Local ABC affiliate WCHS reported that the girl in the video was one of Burgy’s family members. After authorities obtained a copy of the video a few days later, they arrested her on a felony charge of child abuse resulting in injury. A grand jury indicted Burgy in July on child abuse charges, according to local CBS affiliate WOWK. It’s also unclear how police obtained a copy of the video.

Burgy pleaded guilty to unlawful assault on Tuesday but Cabell County Circuit Judge Gregory L. Howard did not accept the plea deal. Instead, Howard deferred adjudication and placed Burgy on probation for three years. If she completes the probation successfully the plea would be reduced to a misdemeanor battery charge. If she doesn’t complete the probation, the judge can reinstate the unlawful assault charge and she could face up to five years in prison. Records show Burgy was also arrested for domestic assault back in March. That case was dismissed.
