Virginia Man Sentenced to Over 3 Years for Capitol Assault, Justice Department Continues Nationwide Prosecutions

On November 12th, a Virginia man received a 37-month prison sentence following his conviction for offenses during the turbulent Jan. 6 Capitol breach, where he was found guilty of assaulting law enforcement among other charges; Micaiah Joseph, 33, from Triangle, Virginia, was also given a 36-month supervised release and was ordered to restitute $2,000.

According to court documents, Joseph donned in a tricorn-style hat, gas mask, and body armor, played a role in the mob that fiercely confronted police at the Capitol’s Lower West Terrace entrance, notoriously called the “Tunnel,” and he was convicted on June 10, of two felonies, including civil disorder and assaulting, resisting, or impeding certain officers, he was additionally convicted of entering and remaining in a restricted building or grounds, engaging in physical violence, disorderly conduct, and obstructing passage through the Capitol grounds, this according to the

The sentencing, handed down by U.S. District Judge Rudolph Contreras, comes after an extensive investigation by the FBI’s Washington Field Office with assistance from U.S. Capitol Police and the Metropolitan Police Department; Joseph’s arrest took place nearly two years post-incursion, on January 18, 2023, and he was immediately taken into custody in Virginia.

Over the course of more than three and a half years since the Capitol Siege, the slow grind of justice has seen over 1,561 individuals across the nation facing charges related to the Capitol breach and of those, more than 590 individuals have been charged with assaulting or impeding law enforcement, Joseph’s case among them, a token of a broader reckoning that has been unraveling since the historic and chaotic day as the
